Dealer putting me between a rock and a hard place…

Evening guys and gals.

I’ve tried to figure things out on my own without posting much on here, but I’m down to the last straw.

Situation… I ordered a 2022 3500 January 26, fully loaded with everything but a sunroof. Salesperson had verbally promised me (my own fault not in writing) that if the truck were delivered when I was working, they would hold the truck for an unlimited time until I had returned from work to purchase it. I work on an oil tanker, so away from home for 75 days at a time.
I get a call a few weeks back that my truck has arrived and I can come pick it up. Told new salesperson that I was away till mid September and his GM had said they can’t hold the truck for that long…
To their credit, the dealer did offer to meet me in port and sign over the documents to the new truck, and get the keys for my trade in. But that just seemed way too sketchy to me, and I wanted to see the truck before paying nearly 100k for it. Plus had a few things I wanted to keep on my trade.

I’ve been emailing back and forth with the dealer for the past week and yesterday they confirmed that “it is against company policy” to hold the truck, and that it would be for sale to the regular public. Wtf! I’ve been given no firm dates that the truck needs to be off the lot, I’ve been given no statements with the policy verbatim in it. This smells fishy.

I am under the impression that the dealer is trying to snake me out of a 100k unicorn truck that I ordered, and charging a ADM on it to some guy walking down the street.

Does the 1000 dollar deposit I put down mean nothing? The acknowledged that my initial salesman (now finance manager) said these things, but they’re turning it back on me saying new stuff.

I don’t want to do business with this dealer, but I still want the truck I have been waiting 7 months for , and more than that, I don’t want them to get away with this sneaky stuff!!!

If you have it in writing that they acknowledged the verbal agreement maybe you have some standing?

Unfortunately to my understanding most dealer's fine print basically says the written contract supercedes any verbal agreement so if it's not in writing you may be sol.

If they offered to meet you in port to sign papers I feel like that's fair. You can inspect it before signing. If they fail to deliver your vehicle and they can't provide you a written policy that you're breaking you probably get your deposit back even if they take some convincing.
 
Also maybe you can have a family member check it out for you. I know in your other post you said you wanted to diy, but if they miss something like a small scratch nbd. It's going to get scratches anyway. Any major issue you have the warranty to cover.
 
So it seems that they made a reasonable attempt to accommodate you by meeting you at the port. I guess from their standpoint, maybe they are worried about the value of your trade in going down in the coming months. If I were in your shoes and I really wanted the truck, I'd take the deal and lose whatever extras are on the current truck. I was in a similar but opposite deal with mine. I watched my trucks value drop considerably in the 7 months that passed while I waited for mine. It was to the point that I considered passing on my ordered truck and just keeping my old one. At the time of delivery, I was able to sell mine for an acceptable price. That coupled with the price increases on the new trucks, the deal was still favorable. Not sure of your exact situation but the options and pricing on the 23s wasn't looking great to me.
 
Are you paying MSRP or lesser from January? Are they trying to charge you the current MSRP price? You have $1000 down so that should have price locked when you made the deal. Maybe a family member or friend could remove the parts that you want to keep from your trade. I would take in account the agreed upon price against how much it has now gone up to order another one and the fact that trade values continue to go down as the interest rates continue to rise. As already mentioned, 23's may not be something you want and new 22 orders are getting closer to shutting down.

This still gives me a sketchy feeling… maybe I’m thinking in the wrong, but man it just irks me knowing that my hands are tied and they can do whatever they please.

You should have prepared for this. I dont care what they said to you thats a lot of money for them to sit on waiting for you to get back. They were wrong to have said they would hold it but at the same time you should have prepared to have some one ready to receive it for you and the trade stripped down before you went off to work. Its a bad situation but its also a brand new truck with a warranty so sight unseen is irrelevant as someone can always check for scratches for you the rest would be covered under warranty anyway
 
Agreed, I will absolutely better prepare next time. It’s easy for me to get defensive about it all, but I realize the mistakes I made. Always heard some dealerships were scummy places, but never expected it to happen to me.
Tomorrow is a new day, maybe they’ll still have it on the lot when I get home ‍♂️♂️
 
I had mine dealer traded from about 300mi away. Signed and paid but didn't see it until they pulled it around from wash bay. Looked ok, got it home started loading a few sand bags in back for winter ballast. The light hit the roof just right and I could see appx 8 golf ball size dents in the roof. In the GB I find a note from a Or HS thanking dealer for use in their homecoming parade. Imagine some roid pumped jock beats his d**k beaters all over my roof. Dealer offered to dent removal it but since that was going to require dropping my new headliner I chose to fuggetaboutit. Beauty of being only 5'7", I can't see it anyways! While I probably wouldn't want to accept what you're having to do. Once your booty's in the captains chair you likely won't care. I don't after 3yrs. of rock chips and basic wear n tear. Of course a Laramie was $55k in those says..
 
I believe it's a requirement on any sold truck that's ordered that the buyer takes delivery within 2 weeks. I know that was the case with mine and is also being communicated on a Gladiator build I'm looking at.
 
BubbaWilkins is correct. The way Mother Mopar has it written, if a Sold order is not delivered to the customer that placed the order within 14 days, the dealership gets re-invoiced at the current price. For example if I order and sign for a $65000 truck, and in the whatever timeframe it takes to get it, the truck now costs $74000, the dealership has to pay the difference. I would much rather sell it to the original customer for the lower price than to a random person.

If its fully loaded it may still be there when you get back not everyone wants to drop that kinda money on a vehicle with this economy lol

I am aware of a guy that had his come in and it was sitting on the lot waiting for him to pick up and some other guy came in saw it, said it was perfect and offered like 20K over the MSRP and they sold it to him... The lawsuit between the original buyer and the dealership is apparently gone all the way to the top of FCA/Stellantis and the dealership (a Lithia dealership) is apparently in deep deep doo doo of some sort...and possibly not only a civil matter but a criminal one...
